More and more pensioners are demanding refunds for the health insurance contributions (CASS) withheld from their pensions, but institutions say there is no legal basis for reimbursement until the Constitutional Court (CCR) issues a ruling.

A growing number of pensioners are submitting requests to pension offices seeking the reimbursement of amounts withheld for CASS (the National Health Insurance contribution). However, representatives of these institutions point out that, for the time being, there is no legal basis that would allow the money to be returned, and they are urging people to stop submitting such requests.

The measure in question is the 10% CASS deduction applied from 1 August 2025 to pensions exceeding 3,000 RON, with the contribution calculated only on the portion above this threshold. The state thus collects approximately 100 million euros per month from pensions.

Many pensioners consider this deduction unjust, arguing that they have already contributed to the social insurance system throughout their entire working lives.

The matter has been referred to the Constitutional Court of Romania. Until the CCR issues a ruling or new legislation is adopted on the subject, pensioners' requests for reimbursement cannot be resolved.
